ACLU attorney Ben Wizner with the National Security Project will reflect on his time in Guantánamo as a human rights of observer of the trial of Salim Hamdan. He will also discuss his upcoming 9th Circuit argument about whether the district court erred in dismissing the action on the basis of the evidentiary state secrets privilege, prior to discovery, without first allowing plaintiffs to prove their claims with nonprivileged evidence and without adequately considering alternatives to dismissal.
