Enforcing Flag Law Is A Long Shot

Publication Date:
October 29, 2007
Omaha World-Herald
Joe Dejka

Lecturer in Law and Executive Director of the Constitutional Law Center Derek Shaffer is quoted in an Omaha World-Herald story about the constitutionality of flag burning, and that, even though it is still on the books, it is a "dead letter" law:

Derek Shaffer, executive director of the Stanford Constitutional Law Center, said Nebraska's flag mutilation statute is "patently unconstitutional" under the Texas case and the ruling that came a year later nullifying the Flag Protection Act.
