The "vast majority of states" have taken the first course, said Stanford University sentencing authority Jeffrey Fisher, who won a U.S. Supreme Court decision striking down Washington state's sentencing system in 2004.
Fisher said states have split over the manner in which cases should be handled while their legislatures and courts have adjusted to the high court's prior rulings.
Gold and Fisher speculated that it would be ruled applicable to California cases decided at least as far back as the high court's Washington state decision in 2004.
