Plant Variety Protection Act Does Not Preempt State Law Trade Secret Action
The Plant Variety Protection Act of 1970 does not preempt the owner of a patent in a variety of hybrid corn from bringing a claim for misappropriation of trade secrets under Wisconsin law, the U.S. District Court for the Western District of Wisconsin ruled Oct. 27.
