The Plaintiffs' Lawyer: Institutional Constraints and Ethical Challenges

Study of the challenges, pressures, and opportunities the plaintiffs' lawyer confronts illuminates some of the most vexing and important issues in contemporary civil litigation. This course will explore the ethical demands (including requirements imposed by the Rules of Professional Conduct) and institutional constraints that impact lawyers who specialize in bringing lawsuits. Topics addressed will include the historical evolution of plaintiff-side law practice, the use and abuse of the contingency fee, lawyer advertising, the legality and normative consequences of client solicitation (and relatedly, "ambulance chasing"), the informal referral market for legal talent, the propriety of secret settlements and lock-out agreements, and the unique ethical issues posed by class actions.
