In a surprising and potentially risky move, attorneys for former Brocade Communications CEO Greg Reyes said Friday that they have decided against calling any defense witnesses in Reyes' trial on charges of security fraud related to backdated stock options.
The disclosure came after a judge denied a defense motion for a mistrial in the case, which means both sides will present closing arguments to the jury in San Francisco federal court Monday.
"Sometimes the best strategy is to say, 'Oh please, this isn't even worth responding to,' " said Robert Weisberg, a Stanford law professor and criminal justice expert.
